General terms of use and sale
The online watch store VERRE-DE-MONTRE.com (URL: www.verre-de-montre.com/) is operated by VERRE-DE-MONTRE.com. Any order placed for a product listed on the VERRE-DE-MONTRE.com online store implies prior consultation of these general terms of sale. The customer accordingly acknowledges that they are fully informed of the fact that their agreement regarding the content of these terms does not require a handwritten signature, given that they wish to order online the products presented on the website.
Customers may save these terms of sale; saving the document is their sole responsibility.
The VERRE-DE-MONTRE.com online store on the website provides the following information:
- Legal notice allowing precise identification of VERRE-DE-MONTRE.com.
- Presentation of the essential characteristics of the goods on offer.
- Indication, in euros, of the price of the goods and, where applicable, of shipping costs.
- Indication of the payment, delivery and execution terms.
- The existence of a right of withdrawal (see Article 16).

- The conditions for terminating the contract where it is concluded for an indefinite period or a term of more than one year.

Article 1: Entirety
These terms of sale express the entirety of the parties' obligations. The customer is deemed to accept all the provisions of these terms without reserve. No general or specific terms set out in documents sent or supplied by the customer may be incorporated into these terms.
Article 2: Purpose
The purpose of these terms of sale is to define the rights and obligations of the parties in connection with the online sale of goods and services offered by VERRE-DE-MONTRE.com to the customer.
Article 3: Contractual documents
This contract is formed by the following contractual documents, listed in descending order of precedence: these general terms of sale and the order confirmation. Where provisions in documents of different rank conflict, the provisions of the higher-ranking document prevail.
Article 4: Entry into force - Duration
These terms of sale enter into force on the date the order is recorded, that is, upon confirmation by the customer when they tick the box reading "I have read and unreservedly accept the general terms of sale" at checkout. These terms are concluded for the period required to supply the goods and services purchased, until expiry of the warranties owed by VERRE-DE-MONTRE.com.

Contractual information is provided in French and will be confirmed at the latest when your order is validated.
MY-MONTRE reserves the right not to register a payment and not to confirm an order for any reason whatsoever, in particular in the event of a supply issue or any difficulty regarding the order received.
Article 5bis: Pre-orders
Part of our site operates on a pre-order basis, meaning the dispatch time is longer for these orders. By placing a pre-order, the customer acknowledges the lead time indicated on each product page.
5-a Pre-orders and price changes
1. Definition of pre-order
A pre-order allows the customer to purchase a product before it is actually available. The delivery date shown is an estimate and may vary depending on the supplier's production and supply lead times.
2. Price changes before delivery
The price of a pre-ordered product is based on the pricing information available at the time of listing. However, due to fluctuations in supply costs, taxes, or other external factors beyond our control, we reserve the right to adjust the price before delivery.
3. Options in case of a price change
If the price of the product increases after the order but before delivery, the customer will be informed as soon as possible and may choose between:
- Keeping the order at the new price, after express acceptance of the change.
- Cancelling the order and receiving a full refund, with no penalty.
4. Seller's commitment
If the price change is minor or can be absorbed by us, we will do our best to honour the order at the original price. However, if delivering at the agreed price would mean selling at a loss, we reserve the right to cancel the order and refund the customer in full.
5. Force majeure and product unavailability
In the event of product unavailability due to exceptional circumstances (supplier stock shortage, halted production, embargo, etc.), the order will be cancelled automatically and the customer refunded without delay.
5-b Payment terms
Order payment and deposit
For a pre-order (a product requiring resupply), a deposit equal to 30% of each pre-ordered item is included when the order is placed. The full price balance is payable on the day the order is placed.
5-c Pre-order cancellation
If the customer cancels the pre-order during the period indicated on the product page (up to 21 working days), a 30% deposit on each pre-ordered item will be retained by the seller as of right.
If the pre-order target shown on each product page is not reached and the customer wishes to cancel the order, they will be refunded in full, including the deposit.
Any pre-order placed for products listed on the Verre-de-Montre.com site implies prior consultation and unreserved, irrevocable acceptance of these general terms. The customer accordingly acknowledges that they are fully informed that their agreement to these terms does not require a handwritten signature. The customer declares that they have legal capacity to enter into this contract, i.e. that they are of legal age (eighteen years old) and not under guardianship. The parties agree that their dealings shall be governed exclusively by these terms.
Article 6: Electronic signature
The customer ticking the box on the order form labelled "I have read and unreservedly accept the general terms of sale" constitutes an electronic signature having, between the parties, the same value as a handwritten signature.
Article 7: Order confirmation
Contractual information will be confirmed by email no later than at the time of delivery, or failing that, at the address provided by the customer on the order form.
Article 8: Proof of transaction
Computer records kept on VERRE-DE-MONTRE.com's information systems under reasonable security conditions shall be considered proof of the communications, orders and payments between the parties. Order forms and invoices are archived on a reliable and durable medium that can be produced as evidence.
Article 9: Product information
9-a: VERRE-DE-MONTRE.com presents products for sale on the website together with the characteristics required by article L 111-1 of the French Consumer Code, allowing the potential customer to know the essential characteristics of the products before placing a final order.
9-b: Offers presented by VERRE-DE-MONTRE.com are valid only while stocks last.
Article 10: Prices
Prices are stated in euros and are valid only on the date the customer submits the order form. They include shipping costs, which are shown before final validation. Prices include VAT applicable on the order date, and any change in the VAT rate is automatically passed on to product prices. The full price must be paid at the time of ordering. At no point shall the sums paid be considered as a deposit or down payment.
Article 11: Payment methods
To pay for the order, the customer may choose from any of the payment methods listed on the order form. The customer guarantees that they have the authorisations required to use the chosen payment method when submitting the order. VERRE-DE-MONTRE.com reserves the right to suspend order processing and delivery in the event of refusal of card authorisation by the accredited bodies or in the event of non-payment. VERRE-DE-MONTRE.com also reserves the right to refuse to make a delivery or honour an order from a customer who has not paid in full or in part for a previous order, or with whom a payment dispute is being handled. VERRE-DE-MONTRE.com has implemented an order verification procedure to ensure that no one uses another person's bank details without their knowledge.
Article 12: Product availability
Orders will be fulfilled within 3 days of the day after the customer placed their order. If the ordered product is unavailable, in particular due to VERRE-DE-MONTRE.com's suppliers, the customer will be informed as soon as possible and may cancel the order. They may then request either a refund of the amounts paid within 30 days of payment, or an exchange. Pre-ordered products have a longer dispatch lead time shown on each product page.
Article 13: Order validation
Any order placed on the VERRE-DE-MONTRE.com site implies acceptance of these general terms. Any order confirmation entails full and unreserved acceptance of these general terms of sale.
All data provided and the recorded confirmation will constitute proof of the transaction. The customer declares that they have full knowledge of this. The order confirmation constitutes signature and acceptance of the operations carried out. A summary of the order details will be sent via the order confirmation email.
Article 14: Right of withdrawal
In accordance with articles L221-18 et seq. of the French Consumer Code, you have 30 calendar days from receipt of your order to exercise your right of withdrawal, without having to give a reason or pay any penalty.
To exercise this right, notify us of your decision to withdraw by an unambiguous statement: via your personal account, via our contact form, or by sending us the model withdrawal form.
You then have 15 days from the date you notify us of your decision to withdraw to return the goods to us.
You are free to choose the carrier for this return; tracked shipping is recommended but not required. Return shipping costs are at your expense, unless otherwise stated at the time of order.
No product sold on the site is excluded from the right of withdrawal, including watch movements, batteries and watchmaking consumables. However, you are liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and proper functioning (article L221-23 of the French Consumer Code): a deduction proportionate to this diminished value may be applied to the refund. Each watch movement is marked with invisible UV ink and photographed before shipment; the match between the item shipped and the item returned is systematically checked on receipt of the return.
We will refund all sums paid, including standard shipping costs, no later than 15 days from receipt of the returned goods or proof of their dispatch, using the same means of payment as for the original transaction, unless you expressly agree to a different means.

Article 15: Delivery terms
Products are delivered to the address provided by the customer on the order form. The customer is required to check the condition of the packaging on delivery and to note any transport-related damage on the delivery slip and to inform VERRE-DE-MONTRE.com within one week (see Article 16). On request, the customer can have an invoice sent to the billing address rather than the delivery address by selecting the relevant option on the order form. As soon as VERRE-DE-MONTRE.com dispatches an order, the customer immediately receives an email notification.
If the delivery address provided to My-montre.com does not allow the postal service to deliver the parcel, My-montre.com will contact you to resend the parcel to a different valid address, subject to an additional shipping fee. If this second address also turns out to be incorrect, My-montre.com will refund you upon return of the parcel to our premises, after deducting the cost of both shipments at the rate in force.
VERRE-DE-MONTRE.com offers a variety of shipping options. The customer can choose between tracked and untracked shipping. Untracked shipping is at the customer's own risk. If the customer chooses untracked, uninsured letter shipping, and the delivery is delayed or appears lost, Verre-de-Montre cannot be held liable, and the customer waives any claim for refund or compensation related to this inconvenience.
LA POSTE (tracked shipments only)
To minimise shipping costs, all small or medium-sized products are sent in padded envelopes. Besides being economical, this envelope type is delivered quickly throughout France. However, as with any shipment, delivery may be delayed or the parcel lost. In the event of a delay compared with the date shown in the dispatch email, please report it to us by email. We will then contact La Poste to open an investigation, which can last up to 21 days from its start date. If the product is found during that period, it will be re-routed to your address (which happens in most cases). If the product is not found at the end of the 21-day investigation, La Poste considers the parcel lost. Only at that point can we send a replacement at our expense, provided you chose tracked shipping. If the product is no longer available at that time, we refund the amount of the affected items. If the product is still available but its sale price has changed, we apply the new sale price and refund the difference by bank transfer. We decline any responsibility for delivery delays caused by the carrier, particularly in the event of lost parcels or strikes.
Article 16: Delivery problems caused by the carrier
Any delivery anomaly (damage, missing item against the delivery slip, damaged parcel, broken products, etc.) must be noted on the delivery slip in the form of "handwritten reservations" with the customer's signature. The customer must also confirm the anomaly by sending the carrier a registered letter with acknowledgement of receipt setting out the complaint within 2 working days of the delivery date. Article 17: Delivery error
17-a: The customer must report any delivery error and/or product non-conformity (in nature or quality) against the order to VERRE-DE-MONTRE.com on the day of delivery or, at the latest, on the first working day after delivery. Any complaint made beyond that period will be rejected.
17-b: Complaints may be submitted to VERRE-DE-MONTRE.com: preferably by simple electronic message via the online store by filling in the form labelled "Add a message" attached to the order in the "My orders" section, or by email via the contact form on the "Contact us" page.
17-c: Any complaint not made in accordance with the above rules and within the time limits cannot be considered and releases VERRE-DE-MONTRE.com from any liability towards the customer.
17-d: On receipt of the complaint, VERRE-DE-MONTRE.com will issue an exchange number for the product(s) concerned and communicate it to the customer by email or telephone. A product can only be exchanged after the customer has received an exchange number under the procedure described above.
17-e: In the event of a delivery error or exchange, the product must be returned complete to VERRE-DE-MONTRE.com at the following address. When the error is ours, return costs are borne by us (prepaid label on request). You are free to choose the carrier; tracked shipping is recommended. The product may have been handled to check its nature and proper functioning (article L221-23 of the French Consumer Code).

For a return to be accepted, it must first be reported to VERRE-DE-MONTRE.com's Customer Service.
Shipping costs are borne by VERRE-DE-MONTRE.com, unless the returned product does not match the customer's original return statement.
Article 18: Product warranty
Extract of the applicable legal notice (article D211-2 of the French Consumer Code):
"The consumer has two years from delivery of the goods to obtain enforcement of the legal guarantee of conformity in the event a defect of conformity appears. They may choose between repair or replacement of the goods, subject to the cost conditions set out in article L217-9 of the Consumer Code. They are exempt from having to prove the existence of the defect of conformity during the twenty-four months following delivery of the goods. The legal guarantee of conformity applies independently of any commercial guarantee granted. The consumer may decide to invoke the guarantee against hidden defects in the item sold within the meaning of article 1641 of the Civil Code. In that case, they may choose between rescission of the sale or a reduction of the sale price in accordance with article 1644 of the Civil Code."
In accordance with Article 4 of French decree no. 78-464 of 24 March 1978, the provisions of these terms of sale cannot deprive the customer of the statutory warranty obliging the professional seller to guarantee them against all consequences of hidden defects in the item sold. The customer is expressly informed that VERRE-DE-MONTRE.com is not the manufacturer of the products presented on the website within the meaning of French law no. 98-389 of 19 May 1998 relating to liability for defective products. Accordingly, in the event of damage caused to a person or property by a defective product, only the manufacturer's liability can be sought by the customer. Given how often the components of technical products are renewed, VERRE-DE-MONTRE.com can, on request, inform the customer about the availability of spare parts for the products offered and how to obtain them.
Article 18bis: Consumer mediation

Article 19: Usage rights
The right to use software supplied or distributed by VERRE-DE-MONTRE.com is granted to the customer on a non-exclusive, personal and non-transferable basis, in accordance with the French Intellectual Property Code. However, under Article L122-6-1 of that Code, the customer has the right to reproduce the software for the sole purpose of making a back-up copy where necessary to preserve use of the software. In any case, the author of the software retains ownership of their work, which the customer agrees to respect.
Article 20: Force majeure
Neither party shall be deemed to have failed in its contractual obligations to the extent that their performance is delayed, hindered or prevented by an unforeseen event or force majeure. Force majeure includes any irresistible facts or circumstances external to the parties, unforeseeable, unavoidable, beyond the parties' control and that they could not prevent despite all reasonable efforts. The party affected by such circumstances shall notify the other within ten working days of becoming aware of them. The two parties shall then meet within one month, unless prevented by force majeure, to examine the impact of the event and agree on the conditions under which the contract will continue. If the force majeure event lasts more than three months, these terms of sale may be terminated by the aggrieved party. Force majeure events expressly include, in addition to those usually accepted by the case law of French courts: the blocking of means of transport or supply, earthquakes, fires, storms, floods, lightning; the shutdown of telecommunication networks, or difficulties specific to telecommunication networks external to the customers.
Article 21: Partial invalidity
If one or more provisions of these terms of sale are held invalid or so declared under any law, regulation, or final decision of a competent court, the other provisions shall retain their full force and effect.
Article 22: No waiver
The failure of either party to invoke a breach by the other party of any of the obligations covered by these terms of sale shall not be construed as a future waiver of the obligation in question.
Article 23: Headings
In the event of any difficulty in interpretation between any of the headings appearing at the top of the clauses and any of the clauses, the headings shall be declared non-existent.
Article 24: Governing law
These terms of sale are governed by French law, as to both substance and form. In the event of a dispute or claim, the customer shall first contact VERRE-DE-MONTRE.com to seek an amicable resolution.
Article 25: Data protection
The information requested from the customer is necessary to process their order and may be shared with VERRE-DE-MONTRE.com's contractual partners involved in fulfilling the order. The customer may write to VERRE-DE-MONTRE.com at the contact details set out in the privacy policy on the website to object to such sharing, or to exercise their rights of access and rectification of information about them held in VERRE-DE-MONTRE.com's files, under the terms of the French law of 6 January 1978. The customer may also, as a first step, exercise their rights of access and rectification using the forms available in the "My account" section after logging in to the VERRE-DE-MONTRE.com online store.
